This Privacy Policy does not apply to information collected through third party websites or services that you may access through the Website. By using the Website or Services, you agree to the terms of this Privacy Policy.

Information We Collect and How We Collect It

 Depending on how you use the Website and Services, we or third parties working on our behalf may collect Personal Information from or about you or other individuals affiliated with you, such as your family members, guests, or authorized users of your membership account. “Personal Information” includes any information that we collect about you that, alone or in combination with other information, can be used to identify you, such as a personal identifier, an identification number, online identifiers, or inferences about your preferences. Personal Information does not include publicly available information or information that is anonymous or aggregated so that it cannot be used to identify individuals who use the Services. Use of the Website or Services. We work with a third party payment processor to securely process your payments on our behalf. We do not process or store your payment card information.

Preferences and Inferences. Based on your use of the Services, we may collect inferences to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, and attitudes.

Professional or Employment Information. If you are a Momentum employee or apply for employment with us, we may collect other certain information, such as financial information (including bank account and tax information), employment eligibility, information regarding your job history and other professional qualifications, and similar employment-related information.

Personal Information Collected from Other Sources. We may receive Personal Information about you from publicly available databases when we carry out screening as part of our membership application process or otherwise to comply with applicable laws.

We do not ask you for sensitive Personal Information, such as your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, health information, biometric information, or other protected class information (such as military or veteran status). However, if you choose to provide us with this information, we may retain it.

  • To respond to your request or to communicate with you; 

  • To provide you with information or Services you requested, including by processing reservations or transactions that you request;

Momentum is based in the United States, and the Website and Services are designed for users in, and operated from, the United States. If you reside outside the United States and use our Website or Services or otherwise provide information to us, you acknowledge that your information will be transferred to and processed in the United States and in accordance with the laws of the United States, which may not provide the same levels of privacy protection as the laws in your jurisdiction. 

Data Retention

We retain Personal Information for as long as reasonably necessary for the purposes for which it was collected. In some circumstances, we may retain Personal Information for longer periods of time to comply with applicable legal, tax, and regulatory requirements. 

Marketing Communications

We may email marketing correspondence to you about our Services. To unsubscribe from these communications, please follow the unsubscribe instructions contained in the emails or contact us using the contact information below. 

If you sign up to receive text messages from us, you agree to receive occasional promotional communications. To opt out of receiving future text messages from us, you can respond to the text message with “STOP” or “UNSUBSCRIBE”.

We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected Personal Information. If we cannot verify your identity to comply with a request, we will explain the reason to you.

Authorized Agent. You may use an authorized agent to submit a request. When we verify your agent’s request, we may verify both your and your agent’s identity and request a signed document from you that authorizes your agent to make the request on your behalf. To protect your Personal Information, we reserve the right to deny a request from an agent that does not submit proof that they have been authorized by you to act on their behalf.

Sale or Sharing of Personal Information. Momentum does not “sell” Personal Information, as that term is defined in the CCPA; however, we may “share” certain Personal Information with our partners to provide you with personalized content or targeted advertisements which may be relevant or of interest to you. You have a right to opt out of such sharing under CCPA by reaching out using one of the methods listed in the “Contact Information” section below. We do not knowingly sell or share any information of any individuals younger than 16 – for more information, please see the “Children’s Privacy” section. 

Other California Privacy Rights. Under California’s “Shine the Light” law (California Civil Code Section 1798.83), California residents are entitled to request and obtain from Momentum once per calendar year information about when we share your Personal Information with third parties for those third parties’ own direct marketing purposes.

We reserve the right to modify this Privacy Policy at any time by posting the revised version on the Website and updating the last modified date. We encourage you to review the Privacy Policy whenever you access the Website or otherwise interact with us to stay informed about our privacy practices.
